Ombudsman Slapped Graft Charges Against Former Kumalarang Mayor

THE Office of the Ombudsman has slapped graft charges against the former mayor of Kumalarang, Zamboanga del Sur for designating his cousin of all people as municipal treasurer in 2007.
The respondent, current town Vice Mayor Allan Damas, was charged with the violation of Section 3(e) of Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act) over his supposed illegal appointment of kin Nellie Toledo some eight years ago.
Ombudsman Conchita Carpio-Morales earlier found probable cause to indict Damas, noting in a resolution that the politiko “gave unwarranted benefit, advantage or preference to Toledo as she was appointed in violation of Section 79 of the Local Government Code of 1991.”
The particular law prohibits the appointment in the career service of any person who is related within the fourth civil degree of consanguinity or affinity to the appointing or recommending authority, who in this case is mayor-turned-vice mayor Damas.
Likewise the resolution stated that Damas’ “lame excuse that he does not recall the contents of the certification he issued in favor of Toledo…is unavailing” as “it only shows his gross disregard of a fundamental legal requirement in recommendations or appointments to the career service of the local government and his cavalier attitude to and appreciation of the basic tenet that underlies the prohibition.”
